Ecozone firms may opt for 90% work from home – FIRB

Business enterprises in economic zones and freeports may choose to adopt a work from home setup of up to 90%, that is according to the interagency Fiscal Incentives Review Board (FIRB).

The measure seeks to help firms sustain their business operations following the declaration of national energy emergency tied to the ongoing Middle East tensions.

FIRB chairperson and DOF Secretary Frederick D. Go has said, “We are extending full support to our investors as we navigate through this energy emergency, so we can remain competitive and keep their operations running smoothly.”

He added, “In line with our promise in the CREATE MORE Act, we are prepared to provide a responsive incentive that not only safeguard workers, but supports investors and their businesses.”

The resolution says WFH arrangement refers to employees engaged in the registered project or activity.

Meanwhile, the concerned investment promotion agencies may impose a lower threshold of not less that 50% of the total workforce, depending on specific circumstances and the nature of operations of the RBE.

The FIRB has cited Rule 24, Section 3 of the CREATE MORE Act implementing rules and regulations as basis, which allows temporary measures for RBEs affected by exceptional circumstances.

Non-compliance with the IPA-imposed threshold will result in penalties, including payment of regular income tax based on the extent of excess WFH usage.

The temporary policy will remain in effect for one year unless extended or lifted under Executive Order No. 110, s. 2026, which declared the national energy emergency.
